Terms and Conditions

These Terms and Conditions (the "Agreement") outline the rules and regulations for using the services of Sawley Skies Drone Photography ("Sawley Skies"). By utilizing Sawley Skies' services, you ("the Client") agree to be bound by these Terms and Conditions. A copy of these Terms and Conditions will be provided to the Client prior to the commencement of any service.

PAYMENT TERMS

A non-refundable deposit of 25% is required to confirm the booking. The remaining balance is due on the day the work is carried out. All costs will be provided in a detailed quote prior to attendance.

TRAVEL EXPENSES

Travel expenses are included in the prices quoted. This covers travel within a 25-mile radius of the base location. For distances exceeding 25 miles, travel may be arranged by mutual agreement, with an additional charge of £0.50 per mile applied for each mile beyond the 20-mile mark.

POSTPONEMENTS AND CANCELLATIONS

1. Weather Conditions: Weather conditions, including rain, snow, strong winds, and other adverse weather, may affect the ability to safely operate the drone. If weather conditions prevent attendance, every effort will be made to reschedule the service at a mutually convenient time. The 25% deposit will remain non-refundable but will be transferred to the new date. If rescheduling is not possible (e.g., for events such as weddings), 15% of the deposit will be refunded.

2. Travel Disruptions: If travel disruptions affect the ability to attend or cause delays, the terms outlined for weather-related issues will apply.

3. Sawley Skies Cancellation: If Sawley Skies cancels the booking for any reason and the Client does not wish to reschedule, a full refund of the deposit will be issued.

4. Client Cancellation or No-Show: If the Client cancels or the service is not attended for any other reason, no refund will be provided.

PERSONAL PROTECTIVE EQUIPMENT

If a location requires the use of specific PPE, the Client is responsible for providing such equipment, ensuring it is in good condition and suitable for use. The Client must provide any site-specific risk assessments relevant to the drone operator prior to attendance. Sawley Skies will provide a high-visibility vest and boots, as required.

NO GUARANTEES

No specific shots are guaranteed. The Client acknowledges that the operator exercises artistic discretion in creating photographs and videos. Sawley Skies reserves the right to refuse to capture images or footage without providing a reason.

COPYRIGHT AND USAGE

1. Copyright Ownership: Unless a separate agreement explicitly outlines a buyout of footage, Sawley Skies retains the copyright to all filmed and photographed content.

2. Usage Rights: Sawley Skies has full usage rights to the material created but will not sell or allow third-party use without the Client’s consent.

3. Internal Promotion: Sawley Skies reserves the right to use any footage or content for internal promotional purposes, including but not limited to use on the Sawley Skies website, social media platforms, printed materials, and other digital media.
   

GENERAL PROVISIONS

1. Amendments: Sawley Skies reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to the Client in writing.

2. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of England and Wales.

3. Limitation of Liability: Sawley Skies' liability for any claim arising out of or related to the provision of services shall be limited to the total amount paid by the Client for the service in question.
